Gawker published other sex tapes without the subject’s consent including a video of a college student having sex in a bathroom stall. Under the bill’s plain language, which prohibits knowingly distributing visual depictions of a person engaging in sexually explicit conduct without consent, Gawker’s distribution of the Bollea sex tape would clearly be illegal, and Gawker Founder Nick Denton could have faced up to five years in jail. But when she introduced the legislation, she issued a press release explicitly noting its focus on “Nonconsensual Pornography, AKA Revenge Porn.” Speier insists that it is not a “revenge porn” bill. Instead, she pushed back at Thiel, insisting: “It is not ‘the Gawker bill’ or the ‘revenge porn bill.’” Her chief of staff Josh Connolly went further, telling the Atlantic that Thiel was self-serving for trying “to conflate our bill with their very specific case.”Īs an IPPA supporter who used the term Gawker Bill, I find this completely befuddling. Paypal Founder Peter Thiel wrote an op-ed endorsing the legislation and added an aside that it was “nicknamed the Gawker Bill.” One would think the Democratic legislator would be thrilled that a well-known Republican billionaire endorsed her legislation in the New York Times. Jackie Speier (D-Calif.), however, seems determined to alienate its conservative supporters.
